It seems that recently not all that glitters in the apple world was of gold. Sales reports in recent weeks confirmed Apple's third-place loss to Xiaomi and now Italy has fined Apple 10 million euros.
The reason for the penalty lies in the misleading advertisement, according to the Italian National Competition Authority (AGCM), that Apple provided regarding the iPhone's water resistance.Apple claimed that its smartphones were water resistant to a depth of 4 meters for a period of 30 minutes, but it was discovered that these parameters were only valid under laboratory conditions, so the AGCM ruled that these conditions did not hold up in the real world.
To make matters worse, AGCM also found that the Californian company did not cover water damage under the guarantee despite its repeated claims to water resistance, a practice the agency deemed "aggressive".
The complaint was filed for smartphones between the launch of the iPhone 8 to the iPhone 11 which, according to the authority, was not clear that it was water resistant only under laboratory conditions.
In defense of the company, Apple always advises against swimming or showering with an iPhone, even though it did so shyly. On the same site, it also indicates that it does not cover water damage in its warranty. This last section in particular is another reason for the penalty as it violates Articles 24 and 25 of the Consumer Law on "aggressive business practices" and "undue coercion or influence."
